Why we are able to process your information

We will collect and store your personal and financial information which will be handled in accordance with the Data Protection Act 2018 as amended, extended, re-enacted or consolidated from time to time.

We will use your information to ensure proper performance of our agreement with you and to comply with our legal obligations when providing the services to you.

What purpose we are processing it for

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • You have made a request for financial advice services to us.

  • You have made a complaint or enquiry to us.

  • You have applied for or already have a job with us.

  • We will use your name, address, email address, contact number, date of birth, national insurance number and financial information (‘personal information’) to provide our services to you and verify your identity.

Whether you have to provide it to us

Your personal information as stated above will only be processed where this is necessary for a specific purpose. Where this is to provide you with financial advice and contracts, our lawful basis for processing is ‘Contract’ and your consent is not required.

Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract”.

We may need to collect “Special Category” data in order to provide you with our services. This includes information about your

  • race;

  • ethnic origin;

  • politics;

  • religion;

  • trade union membership;

  • genetics;

  • biometrics (where used for ID purposes);

  • health;

  • sex life; or

  • sexual orientation.

This may be relevant for example where you require advice on protection or retirement planning products. To do this we will require your explicit consent.

Consent: the individual has given clear consent for you to process their personal data for a specific purpose”.

As we need your consent to process your special category data you have a right to withdraw your consent at any time.

If you would like to be contacted by us about other services we may offer from time to time, this will also require your consent.

You may exercise your right to withdraw your consent and opt-out of receiving any marketing information from us at any time.

How long we store it for

Should you decide not to proceed with our services, we will delete your personal information after 6 years.

Where we provide you with advice &/or arrange contracts with you, we will store your data indefinitely.

Whether there are other recipients of your personal information

We will not share your information with any third parties for the purposes of direct marketing.

We use data processors who are third parties who provide elements of services for us. We have contracts in place with our data processors. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will not share your personal information with any organisation apart from us. They will hold it securely and retain it for the period we instruct.

The provision of our services may require us to pass your personal information to electronic verification providers, product providers or other financial firms such as lenders, banks, insurers, fund managers and platform providers.

We will pass your personal information to Tenet* as they provide compliance services to us. Further detail regarding how Tenet will use your data can be found on it’s website at www.tenetgroup.co.uk or by contacting Tenet on 01132 39 011.

We may be required to pass on your personal information to the Financial Conduct Authority (FCA), Financial Ombudsman Service (FOS) or the Financial Services Compensation Scheme (FSCS) to help with an investigation or complaint or other authorities as required by law.

Whether we intend to transfer it to another country

Your data will not be transferred to another country.

Whether we do automated decision-making or profiling

We will not use your data for automated decision-making or profiling.

Under data protection law, you have rights we need to make you aware of. The rights available to you depend on our reason for processing your information.

Your right of access

You have the right to ask us for copies of your personal information. This right always applies. There are some exemptions, which means you may not always receive all the information we process.

Your right to rectification

You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. This right always applies.

Your right to erasure

You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing

You have the right to ask us to restrict the processing of your information in certain circumstances.

Your right to data portability

This only applies to information you have given us. You have the right to ask that we transfer the information you gave us from one organisation to another, or give it to you. The right only applies if we are processing information based on your consent or under, or in talks about entering into a contract and the processing is automated.

You are not required to pay any charge for exercising your rights. We have one month to respond to you.
